Child Law Advice for Guildford and Surrey
Here at Gregorian Emerson Family Law Solicitors we understand child law advice and can help throughout the Guildford and Surrey area. We will respond quickly to your needs, giving you the information you need and helping to reduce the stress and uncertainty about what the future might hold.
We understand that when a relationship breaks down it can be an extremely challenging time, fraught with emotions and that makes it potentially difficult to sort out suitable child arrangements with your ex partner. Our team of specialists in child and family law can help to guide you through this process and treat each case individually. We will never assume to know your details and will help to make this as easy and stress free as possible. We will provide you with a professional service and listen to your needs.
If you and your ex partner can agree on child arrangements, i.e. who they will live with, how often they will spend with you both, then you should be able to avoid going to court. If you cannot come to an agreement then it would be necessary to take the legal route. We will support you and discuss all the options with you beforehand.
By addressing your dispute at an early stage through our combined legal and psychological approach, we stand an excellent chance of achieving a consensual resolution between you and your spouse/partner. Our aim is to improve the communication between you and your ex partner so that you can communicate effectively and move forward in a mutually agreeable way. We want to help you both to avoid conflict, which is potentially damaging to not just the two of you, but also any children involved who will pick up on the situation. In the unfortunate event that mediation or litigation is still necessary, this strategy, adopted in our early dispute resolution advice, will significantly enhance your case and its presentation in mediation or litigation. We also recognise the importance of improving communication between you both for the future, when the litigation has ended.
Our testimonials speak for themselves.
When you have reached an agreement and wish to make it legally binding we will draw up a ‘consent order’ document, which will detail all information such as, who the child lives with, how often they spend with each parent etc. Once this has been done we can present it to the court to get it recognised. A judge will always put the interests of the child first and foremost and will approve the order as long as you have made decisions which are in the interests of the child and there are no safeguarding issues around the case. We will discuss this thoroughly with you beforehand, so you are fully aware of any legal implications for both you or your ex partner.
You are also able to sort out any child maintenance arrangements yourselves. A ‘family based arrangement’ is a different way to sort this out, also referred to as family arrangements or child maintenance arrangements. These are arrangements where the parents have agreed matters between themselves. These arrangements are flexible, meaning they can be adjusted or changed in the future, as and when, circumstances dictate.
We have expertise in all areas of child and family law including,
• Child arrangements orders
• Relocation (leave to remove)
